Terms of Service

By accessing or using the AutoCart mobile application and website at autocarts.app (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

The Service is operated by NXONDEVS LLC ("we," "us," "our"), a Wyoming limited liability company.

AutoCart is a vehicle deal alerting platform that helps car flippers and dealers find underpriced vehicles on online marketplaces. The Service provides vehicle search monitoring, deal alerts, AI-powered valuations, and listing management tools.

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

To use the Service, you must create an account using your phone number or Google Sign-In. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Providing accurate and current information
• Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms.

Plans

AutoCart offers three subscription tiers:

• Starter — $49.99/month or $14.99/week
• Pro — $100.00/month or $29.99/week
• Advanced — $249.00/month or $69.99/week

Prices are in US Dollars and may be subject to applicable taxes. We reserve the right to change pricing at any time. Price changes will not affect active subscription periods — they take effect at the next billing cycle.

Features

Each tier includes different feature limits for active searches, cities, nearby cities, saved listings, alert speeds, and access to AI valuations and other premium features. Feature details are displayed on the subscription screen within the app.

Payment Processing

All payments are processed securely by Stripe, Inc. By subscribing, you agree to Stripe's Terms of Service and Privacy Policy. We do not store your payment card details on our servers.

Subscriptions may also be purchased through the Apple App Store or Google Play Store, in which case the respective store's terms and billing policies apply.

Recurring Billing

Subscriptions are billed on a recurring basis (weekly or monthly, depending on your selected plan). By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

Automatic Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current rate for your plan at renewal.

Failed Payments

If a payment fails, we may retry the charge and/or suspend your access to paid features until payment is successfully processed. You are responsible for ensuring your payment method is valid and has sufficient funds.

How to Cancel

You may cancel your subscription at any time through:

• The app's Settings screen (which opens the Stripe Customer Portal for web subscriptions)
• Apple App Store subscription settings (for iOS purchases)
• Google Play Store subscription settings (for Android purchases)

Access After Cancellation

When you cancel, you retain access to all paid features until the end of your current billing period. After the billing period ends, your account reverts to the free tier.

Refund Policy

Refunds are handled on a case-by-case basis. To request a refund, contact us at info@nxondevs.com. Refunds for App Store or Google Play purchases must be requested through the respective store.

Plan Changes

You may upgrade or downgrade your subscription tier at any time through the app. When you change plans:

• Upgrades take effect immediately. You will be charged a prorated amount for the remainder of your current billing period.
• Downgrades take effect at the start of your next billing period. You retain your current tier's features until then.

Users without an active subscription have access to limited features as defined by the free tier. Free tier limits may change at any time without notice.

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service or servers
• Use automated systems (bots, scrapers) to access the Service without our written consent
• Resell, redistribute, or commercially exploit the Service or its data
• Impersonate another person or entity
• Upload or transmit viruses, malware, or other harmful code
• Use the Service to engage in fraudulent vehicle transactions

We reserve the right to suspend or terminate your account for violations of these terms.

No Guarantee of Accuracy

Vehicle listings displayed in the Service are aggregated from third-party sources, including online marketplaces. We do not verify the accuracy, completeness, or legitimacy of any listing. Listings may contain errors, may be outdated, or may have already been sold.

No Agency Relationship

AutoCart is not a party to any vehicle transaction. We do not buy, sell, broker, or facilitate the sale of vehicles. We are a search and alerting tool only. All transactions are between the buyer and seller.

AI Valuations

AI-generated vehicle valuations are estimates based on available market data and are provided for informational purposes only. They should not be relied upon as the sole basis for purchasing decisions. Actual vehicle values may differ significantly.

The Service, including its design, features, code, content, logos, and trademarks, is the property of NXONDEVS LLC and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service without our written consent.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

• THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
• THE RESULTS OBTAINED FROM THE SERVICE WILL BE ACCURATE OR RELIABLE
• ANY VEHICLE LISTING OR VALUATION IS ACCURATE, COMPLETE, OR CURRENT

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NXONDEVS LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless NXONDEVS LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any vehicle transaction you enter into based on information from the Service

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict of law provisions.

Any dispute arising from these Terms or the Service shall first be resolved through good-faith negotiation. If the dispute cannot be resolved within 30 days, it shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the State of Wyoming.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms and revising the "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and NXONDEVS LLC regarding the Service and supersede all prior agreements.
